An hourglass on a dark wooden table against a plain cream wall, for a guide to old state land allotments in Balochistan

If a Balochistan plot or farm traces back to a government allotment made between 15 March 1988 and 18 August 1993 in breach of the Land Lease Policy, the Cancellation of Illegal Allotments of State Land Act, 1996 declares that allotment illegal and cancelled, and the land is resumed by the State. The allottee can claim a refund from the Board of Revenue and apply for a fresh allotment.

We read the full Act on the Balochistan Code, the provincial law portal, on 21 October 2026. It is an old law, but it still decides whether some land titles in the province stand. Anyone buying land whose papers start with a state allotment from those years should read this first.

Allotments made between March 1988 and August 1993 against the lease policy are illegal

Section 3 declares illegal every allotment of state land made between 15 March 1988 and 18 August 1993, both days included, in contravention of the Land Lease Policy, by whatever authority, including a Revenue Officer. Section 4 says they stand cancelled forthwith.

One group is excluded. Allotments to a federal or provincial government department for a public purpose are not covered. The Act extends to Balochistan except the Tribal Areas, and it took effect from 13 January 1994 (section 1).

The land is resumed and the revenue record must be corrected

Section 5 says the land stands resumed in favour of the State and the Revenue Officer of the district must take possession at once. Section 4(2) tells the Revenue Officer to correct the revenue record through the district revenue staff.

That is why a title check matters. An old allotment may still appear in a family's papers while the record has since been corrected. Look at the current entry, using the steps to check land records in Balochistan, and see how the entries read in the explainer on reading a land fard.

SectionWhat it does
3Declares allotments of 15 March 1988 to 18 August 1993 against the policy illegal
4Cancels them at once and orders the record corrected
5Resumes the land for the State and orders refund on claim
6Lets the former allottee apply for a fresh allotment
7Bars challenge in any court and ends pending claims

The Board of Revenue refunds the sale proceeds or lease money when claimed

Section 5(2) says the Board of Revenue shall refund the sale proceeds or lease money to the allottees as and when they claim it. The Act sets no deadline and no form for the claim, and we could not find any rules made under section 8.

If you or your family paid for such an allotment, collect the original allotment order, the challan or receipts and the lease deed. Write to the Board of Revenue in Quetta and ask for a refund, keeping a copy with the diary number. Do not assume that time has cancelled the right to claim, but do not wait either.

  1. Find the allotment order, challans and receipts from 1988 to 1993.
  2. Check the date of the allotment against the 15 March 1988 to 18 August 1993 window.
  3. Check whether it was to a government department for a public purpose.
  4. Write to the Board of Revenue to claim the refund of money paid.
  5. Ask in the same letter whether you may apply for a fresh allotment.
  6. Keep every receipt and diary number.

What each section of the 1996 Balochistan illegal allotments Act does

A former allottee may apply again under the lease policy

Section 6 lets an allottee whose allotment was cancelled apply to the Board of Revenue for a fresh allotment under the Land Lease Policy, but only if he meets every condition of that policy. The 1988 policy is the one the Act defines. A newer policy, notified on 2 April 2026, now governs new leases.

For what the new policy asks, read the guide to applying for a state land lease in Balochistan. It sets plot sizes, a 30 year term and a payment schedule. We have not confirmed how the Board treats a section 6 applicant under the 2026 policy.

Courts cannot hear a challenge and pending claims end

Section 7 bars any court from questioning an order or proceeding under the Act. Any case pending in court against the government or Board of Revenue on a claim about an illegal allotment abates, which means it ends. Section 9 gives the Act priority over other laws.

For a buyer, the lesson is simple. A seller with an allotment from the cancelled window cannot give you a good title, however old the papers. Use the checks in the guide to verifying a property registry before buying and ask for the full chain of title back to the first grant.

Common questions

Which allotments does the 1996 Act cancel?

State land allotments made between 15 March 1988 and 18 August 1993, in contravention of the Land Lease Policy, other than those to government departments for a public purpose.

Do I get my money back?

The Board of Revenue must refund the sale proceeds or lease money when the allottee claims it. The Act names no deadline.

Can I go to court against the cancellation?

No. Section 7 bars any court from questioning orders under the Act, and pending court claims abate.

Can the former allottee get new land?

Possibly. He may apply to the Board of Revenue for a fresh allotment if he meets all the conditions of the Land Lease Policy.

Does the Act apply in the Tribal Areas?

No. Section 1 extends it to the whole of Balochistan except the Tribal Areas.

How do I know if my land is affected?

Check the date and authority of the original allotment, then the current revenue record. We could not read any list of affected plots.

How we verified this

What we checked, where we read it, and what we could not confirm.

We read the full text of the Balochistan Cancellation of Illegal Allotments of State Land Act, 1996 on the Balochistan Code on 21 October 2026. We could not find rules made under it, any list of cancelled plots, or a refund form or deadline. This is general information, not legal advice.
