Under the Islamabad Capital Territory Senior Citizens Act 2021, a parent aged 60 or over who cannot support themselves can claim maintenance from an adult heir through an ADR Centre, and a court can cancel a property gift made on the promise of care if the child stops providing it. Abandoning a senior citizen carries a fine of up to Rs 100,000.

The usual case is painful and familiar. A father transfers the house to a son on the understanding that the son will look after him, and then the care stops. The 2021 Act was written for exactly that. We read it on the Ministry of Law's Pakistan Code page for the Act on 28 October 2026, in the version that includes a small 2026 amendment.

The Islamabad Senior Citizens Act covers everyone aged 60 and over

Section 2 defines a senior citizen as a person aged 60 or more who lives in the Islamabad Capital Territory. The Act applies only in Islamabad. The provinces have their own senior citizen laws, and Punjab's 2026 law starts at 70, not 60.

The Act sets up a Senior Citizens Council under the Ministry of Human Rights, with a Grievance Committee to hear complaints. It promises old-age homes called Dar-ul-Shafqat for indigent senior citizens, and a senior citizen card that unlocks discounts.

Parents can claim maintenance from an adult heir

Section 14 lets a parent who is a senior citizen, and who cannot live on their own earnings or property, apply for maintenance against a legal heir. The heir must be an adult who holds the parent's property now, or would inherit it after the parent's death.

The application goes to an ADR Centre under the Alternative Dispute Resolution Act 2017, not to a regular court. ADR, or alternative dispute resolution, means a mediator helps the family reach a settlement. That is usually faster and cheaper than a suit, and less public.

  1. Write down your monthly needs: food, medicine, rent and utilities, with receipts where you have them.
  2. List your own income and property, to show you cannot meet those needs alone.
  3. Name the adult heirs who hold your property or would inherit it.
  4. Apply for maintenance at an ADR Centre in Islamabad, citing section 14 of the 2021 Act.
  5. If the heir will not settle, take legal advice on a claim in court.

A gift made on the promise of care can be cancelled

Section 13 covers a parent who transferred property, by Hiba-ba-Shart-ul-Iwaz or in any other way, on the condition that the child would provide maintenance and the basic needs of life. If the child refuses or fails, the parent can ask a court to declare the transfer void.

Hiba-ba-Shart-ul-Iwaz is a gift made in return for something, here the promise of care. The condition is the key. If the gift deed or the circumstances show it was made on that promise, the parent has a case. A plain gift with no condition is harder to undo.

Section 13(2) protects the parent's maintenance right even after the property passes on. It can be enforced against a later owner who knew of the right, or who got the property free. It cannot be enforced against a buyer who paid for it without knowing.

Parents who have not yet transferred anything can protect themselves now. Write the condition of care into the gift deed, or keep the property and plan through a valid will (wasiyat) in Pakistan, which only takes effect after death.

Abandoning a parent can bring a Rs 100,000 fine

Section 20 says anyone responsible for a senior citizen's care who leaves them somewhere intending to abandon them can be fined up to Rs 100,000 by the Grievance Committee. Appeals go to the Council within 15 days, and its decision is final.

The Grievance Committee also hears complaints about the card and its privileges. It must decide those within two weeks and can fine anyone who breaks the Act up to Rs 50,000. Where negligence by a hospital causes a death, the fine is at least Rs 1 million.

A tougher criminal law is under discussion. A bill to protect elderly parents under the Pakistan Penal Code and the Criminal Procedure Code was among the Senate bills of 26 October 2026. It is a proposal, not law, until both houses pass it and the President signs it.

The senior citizen card promises 20% off medicines and fares

Section 11 lets a person apply for a senior citizen card at 60. The card is meant to give a 20% discount on medicines, doctors' and lab fees at designated private hospitals, and domestic air, rail and government transport fares, plus free entry to public parks, museums and libraries.

The Act leaves the card's procedure to rules. Our check of the senior citizen card across Pakistan found Islamabad's card still waiting on those rules, so the discounts may not be available at the counter yet.

The Islamabad Senior Citizens Act applies from age 60

How we verified this

What we checked, where we read it, and what we could not confirm.

We read the Islamabad Capital Territory Senior Citizens Act 2021 (Act IX of 2021), including the change made by Act XX of 2026, on the Ministry of Law's Pakistan Code site on 28 October 2026, and the Punjab Senior Citizens Welfare Act 2026 on the Punjab Code portal for the age comparison. We could not confirm whether the Council and its Grievance Committee are working, whether rules for the card have been made, or which ADR Centres in Islamabad accept section 14 applications. Ask the Ministry of Human Rights or the Islamabad district courts before you file.
