How to Register a Trade Union in Islamabad Under the Industrial Relations Act 2012: Papers, the 7 Day Rule and Appeals
Register a trade union in Islamabad or a multi-province firm under the Industrial Relations Act 2012: papers, the 75% rule, the 7 day certificate and appeals.

Short answer: To register a trade union in Islamabad, or in a business that runs in more than one province, apply to the Registrar of Trade Unions under the Industrial Relations Act, 2012. The President and Secretary sign it, with three copies of the constitution and two resolutions. The Registrar must issue the certificate within 7 days, or you can appeal to the NIRC.
The NIRC is the National Industrial Relations Commission, the federal labour body for these establishments. We read the Act on Pakistan Code on 20 October 2026, and the rules below come from its sections 1 to 12. A province's own industrial relations law applies to a business that works in one province only.
This is a live subject this week. On 19 October 2026 the government tabled an amendment to the Act, and the Federal Constitutional Court published a ruling on who counts as a worker for a union.
The federal law covers Islamabad and businesses in more than one province
Section 1(3) applies the Act to workers in any establishment or industry in the Islamabad Capital Territory, or one carrying on business in more than one province. A bank or airline with branches across provinces would be covered, even if the union is in Lahore.
Some workers are left out. The Act does not apply to the police, the armed forces and their installations, people in state administration other than workmen, Pakistan Security Printing Corporation and Security Papers Limited staff, or non-commercial institutions caring for the sick and destitute.
Section 3 gives workers the right to form and join unions without prior permission. Two limits come with it. A worker can belong to only one union at a time, and joining a second cancels the first. Where women work in an establishment, the union executive must include them in the same proportion.

Your application needs a statement, the constitution and two resolutions
Section 7 lists what goes with the application. A statement of the union's details, three copies of its constitution with the members' resolution adopting it, and a resolution authorising the President and Secretary to apply. A federation also needs each member union's resolution.
| Item | What it must show |
|---|---|
| Statement | Union name and head office, date of formation, officers' titles, names, ages, addresses and jobs |
| Membership | Total paid membership and total workers in the establishment |
| Other unions | Names and addresses of registered unions already there |
| Constitution | Three copies, plus the resolution adopting it signed by the meeting's chairman |
| Authority to apply | Members' resolution authorising the President and Secretary |
Get the membership numbers right. They decide whether you meet the one fifth rule explained below, and a wrong figure is a ground for cancellation later.
The constitution must cover 12 matters and set a two year term
Under section 8, the constitution must set out the union's name, objects, use of funds, executive, member benefits and fines, member list, amendment rules, audit, dissolution, elections, no confidence procedure and meetings. Officers serve at most two years per term.
At least 75 per cent of the executive must be workers actually employed in the establishment. Up to 25 per cent can be outsiders, such as a labour lawyer or organiser. The executive must meet at least once every three months and the general body at least once a year.
Every member must be a worker employed in that industry. A worker whose dismissal is being challenged in a court still counts. Where two or more unions are already registered, a new one must have at least one fifth of all workers as members.

Seven steps take a union from meeting to certificate
Hold a general meeting, adopt the constitution, elect officers, authorise the President and Secretary, prepare the statement, file with the Registrar, and wait 7 days for the certificate. If it is refused or not issued, appeal to the NIRC.
- Call a general meeting of the workers who want to join.
- Adopt the constitution by resolution, with the chairman of the meeting signing it.
- Elect the officers and executive under the constitution.
- Pass a resolution authorising the President and Secretary to apply.
- Prepare the statement under section 7 with accurate membership figures.
- File the application, signed by the President and Secretary, with the Registrar.
- If no certificate comes within 7 days, or the application is rejected, appeal to the NIRC.
After registration, notify every change of officers or constitution to the Registrar by registered post within 15 days. Keep filing annual returns. Missing them is one of the grounds on which the Registrar can seek cancellation under section 11.

Cancellation needs the NIRC's permission and you can appeal in 30 days
The Registrar can seek cancellation for fraud, breaking the Act or constitution, missing annual returns, or under 10 per cent of votes in a bargaining agent election. The NIRC must first give permission. The Registrar's orders can be appealed to it within 30 days.
Who counts as a worker can decide a cancellation. On 19 October 2026 the Federal Constitutional Court published a decision in FCPLA No. 388 of 2025, State Life Insurance Corporation v Registrar Trade Unions, NIRC. It allowed State Life's appeal against the refusal to cancel the registration of a State Life field workers' association.
The court relied on State Life's service regulations, which exclude field staff paid by commission from the definition of employee. The decision is marked not approved for reporting, so it settles that case, not every union. Its full text is on the court's site, and the steps to find a Federal Constitutional Court judgment online work for it.
A bill tabled on 19 October would change who appoints the Registrar
The Industrial Relations (Amendment) Bill, 2026, introduced in the National Assembly on 19 October 2026, would have the Prime Minister appoint the Registrar instead of "the Government". It also replaces "Government" with "Division concerned" in about a dozen sections.
The bill does not change the registration rules above. It is not law yet, and must pass both Houses and get the President's assent. Its route is the same one described in how a bill becomes law in Pakistan. For individual disputes with an employer, the separate process to file a grievance petition at the NIRC applies.

How we verified this
What we checked, where we read it, and what we could not confirm.
Last checked 20 October 2026. We read sections 1 to 12 of the Industrial Relations Act, 2012 on Pakistan Code, the Industrial Relations (Amendment) Bill, 2026 as introduced in the National Assembly, and FCPLA No. 388 of 2025 on the Federal Constitutional Court's judgments page. We did not visit the Registrar's office, and we could not find a published fee or form number for registration.
