Australia Stops Family on Most New Student Visas, Pakistan Not Exempt

Australia will stop most new international students from bringing their partners and children, and Pakistani students are not in the exempt group. Home Affairs Minister Tony Burke announced the change on Thursday 17 September 2026, in a package that also targets "visa hopping", Visitor visas, working holiday makers and people who overstay.

We read the minister's media release of 17 September 2026 and the full text of his National Press Club speech the same day. Everything below comes from those two official records. They give the policy, but not the start dates. We could not find a date for any of these Australia visa changes on the Home Affairs website as of 27 September 2026.

The aim is a number. The government wants net overseas migration down from 292,000 to 245,000 in 2026 to 2027, and to 225,000 in 2027 to 2028, the Budget forecasts the release quotes.

Most new students will not be able to bring family

Under the announced policy, new international students and new Graduate visa holders will no longer be able to add a partner or children to their visa. Exemptions cover students from Pacific and ASEAN countries and some courses such as PhDs. Pakistan is in neither region.

ASEAN is the group of South-East Asian nations, such as Malaysia and Indonesia. The Pacific group covers island nations such as Fiji and Samoa.

For a Pakistani couple, that changes the plan. A master's student who expected to take a spouse along on the same visa should now assume the spouse cannot come as a dependant, unless the course is a PhD or another course the final rules exempt. The full list of exempt courses has not been published.

Families already in Australia are protected. Mr Burke said: "Anyone who already has their family attached to a visa and is already here, we're not going to be breaking up families onshore."

Students can only move up the qualification ladder

A student who finishes one course and wants a new Student visa for another will have to go up a level, for example from a bachelor's degree to a master's. Moving sideways or down to a cheaper provider to stay longer is the "visa hopping" the government says it will stop.

Mr Burke split student visa changes into three kinds. A 12-month extension for illness, or because a college collapsed, stays as it is. A switch to a different course at the same level will need a new visa application, so it can be tested. The third kind, "progression" to a new course, is where the new rule bites: "You can go up the qualification scale, but only up the qualification scale."

A plan of a bachelor's, then a diploma, then another diploma is the route being closed.

Visitor visas will carry a No Further Stay condition

All future Visitor visas will carry a "No Further Stay" condition. It means a visitor cannot apply for most other visas from inside Australia, so a trip to see family cannot turn into a longer stay. Protection (asylum) claims are the exception.

Mr Burke argued this will make visitor visas easier to get for genuine visitors, such as parents going to a graduation or a wedding. He said the change "will have no impact on anybody who is already here", because it covers future visas only.

For Pakistani families, the practical rule is simple. Treat a Visitor visa as a return ticket. If a spouse needs to live in Australia, that means a partner visa applied for properly, not a visit followed by an onshore application.

Working holiday and compliance changes

Second and third year Working Holiday Maker visas will go to a ballot capped at 45,000 and 5,000 places. The government will also add 100 compliance officers and 250 detention beds to remove overstayers, returning to pre-2015 practice.

The working holiday change does not reach Pakistanis directly. Pakistan is not on the country list for Australia's Work and Holiday visa (subclass 462), which we checked on the Home Affairs website. It matters mostly for the regional farm and hospitality jobs that backpackers fill.

The compliance change is the one to note. Mr Burke said Australia will go back to detaining overstayers briefly until they arrange their own flight, as it did before 2015. Migration agents who push applications "without merit" can be sanctioned or deregistered under a changed code of conduct.

Skilled visa priority order is changing again

The government will update Ministerial Direction 119, which sets the order in which skilled visas are processed. Healthcare, construction, education, law enforcement, defence, resources, agriculture, aquaculture and fishing get priority, according to the release.

Direction 119 was already reshuffled earlier this year, and we explained that reordered skilled visa queue for Pakistani applicants in August. Mr Burke also said people skilled in the housing trades will get the same points as a university graduate "on implementation", to attract construction workers.

These are announcements, not law yet

None of these measures has a published start date. Mr Burke said the student, visitor and working holiday changes can be made without Parliament. Bigger powers he wants, such as an expression of interest system for students, need legislation he does not have.

That means the changes will arrive as regulations, visa conditions and ministerial directions, one at a time. Until each is made, the current rules apply. Here is what we suggest a Pakistani applicant does now:

1. If you already hold a Student visa with family attached, do nothing. Onshore families keep their status.
2. If you plan to apply with a spouse, check the current rules on the Home Affairs website on the day you lodge.
3. If you are finishing a course in Australia, plan a next course at a higher level, or a Graduate or skilled visa.
4. If your parents want to visit, apply for a Visitor visa with clear proof of return.
5. Never overstay. Detention and removal are becoming routine again.

Anyone weighing Australia against other countries should compare carefully. Scholarships such as the Commonwealth Scholarship through HEC are for the UK, and Fulbright is for the US, each with its own family rules.

Common questions

Can a Pakistani student take a spouse to Australia after this change?

Not on most new Student visas, once the rule starts. The exemptions announced are for Pacific and ASEAN nationals and some courses, such as PhDs.

When do the Australia student visa family rules start?

No start date has been published. The minister announced the policy on 17 September 2026, and the current rules apply until the change is made.

Will students already in Australia lose their family visas?

No. The minister said families already attached to a visa and living in Australia keep their status.
