To remove a farm tenant in Balochistan, a landlord files an ejectment application in the Revenue Court of an Assistant Collector of the first grade, on one of the grounds in the Balochistan Tenancy Ordinance, 1978, such as unpaid rent or subletting. The tenant gets a show cause notice and a hearing, and any order is carried out only after a notice of up to 30 days.

This is the law for agricultural land. For a rented house or shop, use the guide to evicting a tenant through the Rent Controller in Balochistan. We read the full Tenancy Ordinance on the Balochistan Code, the provincial law portal, on 21 October 2026.

The Ordinance names only three kinds of tenant and your ground depends on which

Section 3 lists occupancy tenants, lathband tenants and tenants at will. An occupancy tenant has hereditary or long standing rights. A lathband tenant builds embankments or a well with the owner's consent. Everyone else is a tenant at will (section 9).

Time alone does not create occupancy rights (section 6). That helps landlords. But a tenant at will can still gain the higher status if a competent court decrees it, so check what the revenue record says about your tenant before you file.

Grounds to evict a farm tenant in Balochistan by type of tenant

Unpaid rent, misuse and failure to cultivate are the grounds

Section 31 (occupancy tenants) allows ejectment for failing to pay rent, using the land so it is unfit for its purpose, failing to cultivate as agreed or as is customary, or an unsatisfied decree for rent arrears. Section 32 gives lathband tenants the first three. Section 44 gives tenants at will the same three plus subletting.

Land made unfit for its purposeYesYesYes
Not cultivated as agreed or by customYesYesYes
Unsatisfied decree for rent arrearsYesNoNo
Sublet the tenancyNoNoYes

An occupancy tenant who fails for more than a year, without good cause, to cultivate the land or arrange its rent loses the right of occupancy at the end of that year (section 30).

File the application with attested revenue records

Section 34 says the landlord applies, with one copy for each tenant to be ejected. It must attach an attested copy of the latest entry in the Register Haqdarana Zamin, an attested copy of the latest Jamabandi entry, and attested Girdawari entries for the last two harvests, where those registers exist for the mauza. Statements must be brief and stick to the facts.

Get these copies first. The steps to check land records in Balochistan show where the record sits. If you do not know what the terms mean, see the explainer on reading a land fard.

  1. Confirm the type of tenant from the revenue record.
  2. Choose the ground that fits that type of tenant.
  3. Collect attested Haqdarana, Jamabandi and two Girdawari entries.
  4. File the application in the Revenue Court of the Assistant Collector, first grade.
  5. Attend the hearing after the court serves a show cause notice on each tenant.
  6. Pay any crop and improvement compensation the court sets.
  7. Wait for the notice of up to 30 days before the warrant is executed.
Steps for a landlord to evict a farm tenant in Balochistan

The court may give the tenant a chance to fix the fault

Under section 40, if the injury can be fixed, or money will make it good, the court may order the tenant to remedy it, or pay compensation within a set period, instead of ejecting him. If he does, no ejectment decree is made. This applies to rent, misuse and failure to cultivate.

So a landlord who wants the land back should not expect an order simply because rent is late. A tenant who pays inside the court's period can keep the tenancy.

You cannot evict a tenant without paying for his crop and improvements

Section 37 says no tenant may be ejected without compensation for the standing crop, for land prepared for sowing, and for improvements, as the court decides. Improvements include wells, drains, tree planting, levelling and farm buildings (section 2).

Section 38 adds timing. An ejectment order is not to be executed before the Rabi crop is harvested and after Kharif sowing has started, unless the court records reasons for something else. The notice under section 39 gives the tenant up to 30 days to hand over. A warrant is then executed by an official not below Kanungo rank, with or without police help.

If either side loses, appeals run 30 days to the Collector, 60 days to the Commissioner and 90 days to the Board of Revenue (sections 67 and 68). A tenant who is thrown out outside these rules has his own remedy, set out in our guide on getting a wrongful ejectment reversed.

Common questions

Which court hears a farm tenant ejectment case?

The Revenue Court of an Assistant Collector of the first grade. Section 33 says an ejectment suit by a landlord must be filed there.

Can I evict a tenant just because the season has ended?

Not by itself. You need one of the grounds in the Ordinance, and the order cannot be executed in the protected window between Rabi harvest and Kharif sowing unless the court records reasons.

How much notice must the tenant get?

A notice calling on him to deliver possession within a period not exceeding 30 days, before any warrant of ejectment is issued.

Do I have to pay the tenant anything?

Yes. The court sets compensation for the crop, land prepared for sowing and any improvements, and it must be paid before the tenant is ejected.

What if the tenant sublets the land?

Subletting is a ground only against a tenant at will (section 44). It is not listed as a ground for occupancy or lathband tenants.

Does this law cover a rented house?

No. It covers agricultural tenancies. Houses and shops fall under the rent law and the Rent Controller.

How we verified this

What we checked, where we read it, and what we could not confirm.

We read the full text of the Balochistan Tenancy Ordinance, 1978 on the Balochistan Code on 21 October 2026. The extracted text of this PDF has some garbled lines, so we checked each section number against its heading. We could not confirm district court fees, or whether the Provincial Government has changed the dates in sections 28, 35 and 38 by notification. This is general information, not legal advice.
