Islamabad Condominium Bill 2026: What Apartment Owners and Buyers Get

The Islamabad condominium bill, passed by the National Assembly in May 2026, gives flat owners a title deed, an owners' association and a regulator. Its status.

Islamabad's first apartment ownership law has not reached the statute book yet. The Islamabad Capital Territory Condominium (Ownership and Management) Bill, 2026 was passed by the National Assembly on 13 May 2026. As of 3 October 2026, it does not appear on the Assembly's list of Acts of Parliament.

Some reports already call it an Act. The official record says otherwise, so we treat it as a bill here. Once it becomes law, it says it "shall come into force at once" across Islamabad Capital Territory.

We read the bill as passed by the National Assembly, the Assembly's Standing Committee report of 7 April 2026, and the Senate's committee reports page on 3 October 2026. What follows is what the bill gives flat owners and buyers, section by section.

Where the Islamabad condominium bill stands

The bill cleared the National Assembly on 13 May 2026. The Senate Standing Committee on Housing and Works reported on it on 21 May 2026. It then needs the Senate's vote and the President's assent before it becomes an Act. We found no record of either.

The NA committee chairman added a dissent note. It objects to the insurance duty in section 10, saying conventional insurance involves interest and gambling. The bill as passed still contains section 10.

What the bill gives an apartment owner

The bill gives the buyer of a flat full ownership of that unit, plus a fixed share of the building's common areas. That unit and share can be sold, gifted or inherited like any other property. Your share moves with your flat automatically when it changes hands.

A "condominium complex" in the bill means a building or group of buildings with individually owned units and shared common areas. "Common areas and facilities" means everything that is not a unit: stairs, lifts, corridors, the roof, parking, water tanks and so on.

  • Ownership: section 3 says a unit sold by the builder gives the buyer "exclusive rights of ownership and possession".
  • Common areas: each owner gets a percentage of undivided interest in the common areas, written into the Deed of Ownership.
  • Inheritance and sale: section 4 makes each unit "heritable and transferable immovable property".

The bill calls the builder the "promoter". That covers any authority, person or company that builds or owns the complex, including a government housing body.

Your title deed and the deadlines on the builder

The builder must give each buyer a registered Deed of Ownership. For sales after the law starts, that is within three months of the sale. For flats sold before it starts, the builder has six months from commencement. Lease-based buildings follow the same timelines for sub-leases.

The deed must state the unit, the common areas, the value of the property and of the unit, and your percentage share. The builder files and registers it with the Authority and hands you a certified copy.

Deadlines on builders under the Islamabad condominium bill 2026 for ownership deeds, sub-leases and lease transfers

Many Islamabad buildings stand on leased land. For those, section 5 says the builder must execute a separate sub-lease deed for each flat, on the same terms as the original lease. The builder cannot add new conditions without the Authority's approval.

Once half the flats have been handed over, the builder must transfer the lease itself to the owners' association. For leases granted before the law starts, that transfer is due within one year of commencement.

"Authority" in the bill means the body that approves the building's map and plan. The bill does not name CDA, but in most of Islamabad that body is CDA. Later transfers of a unit follow the Authority's procedure, the same way a CDA plot or house transfer does today.

The owners' association and maintenance charges

Every complex gets an elected Association of Owners. It runs the common areas, collects maintenance contributions into a management fund and can sue and be sued. Until it is formed, the builder stays responsible for maintenance. The bill sets no fixed charge; the association decides it.

  1. The Regulator holds an election within six months of half the units being handed over.
  2. All unit owners and sub-lessees vote, with one vote each, however many flats they own.
  3. The association has at least five elected members and a three-year term.
  4. It meets at least once a quarter, with a quorum of three.
  5. Owners can dissolve it early by a simple majority and elect a new one.
How the owners' association is formed and run under the Islamabad condominium bill 2026

Section 9 lists its duties. It issues a code of conduct, maintains the building itself or through a maintenance company, and runs common areas and utilities. It also sets and collects contributions, and checks that building bylaws are followed. It gives the no objection certificate when a unit is transferred, so unpaid dues could hold up a sale.

Section 10 adds a cost every owner should expect. The association must insure the whole complex against fire, civil commotion, riots, earthquake and bomb blast, and the premium is paid by the unit owners.

Complaints, disputes and the Regulator

If the association breaks the law or fails in its duties, any owner can complain to a Regulator. The federal government appoints or designates that Regulator. Disputes go first to the association's own resolution process, then to the Regulator, whose decision is final.

The Regulator can inspect the builder's or association's records, enter the complex to examine common areas, and order cleaning and maintenance. The bill does not say who the Regulator will be. That, and the dispute procedure, are left to rules the federal government will issue in the Gazette.

Section 7 covers damage. If part of a building is destroyed, the association must repair it in reasonable time. Before an association exists, the builder must restore the building.

What buyers should do before the law starts

Until the bill becomes law, none of these deadlines bind a builder. Buy with the same checks as before: confirm the project is approved, read the lease terms, and get your sale agreement to state your share of common areas and who maintains them.

Start with the land. A building in an unapproved housing scheme will not become legal because of this bill, so check whether the housing society is approved by CDA first. Then ask the builder for the building's approved plan and completion status. If you rent your flat out, the separate duty of registering a tenant with Islamabad police still applies.

Common questions

Is the Islamabad Condominium Act 2026 in force?

Not as far as the official record shows. The National Assembly passed the bill on 13 May 2026, but on 3 October 2026 it was not on the Assembly's list of 2026 Acts.

Does the law apply to flats outside Islamabad?

No. The bill extends only to Islamabad Capital Territory. Sindh has its own Condominium Act from 2014.

How long does a builder have to give me an ownership deed?

Three months from the sale, for sales after the law starts. Six months from commencement, for flats sold before it.

Who sets the maintenance charges in my building?

The elected Association of Owners. The bill lets it determine and collect contributions but sets no amount.

Can a builder keep control of the building forever?

No. An association must be elected within six months of half the flats being handed over. Until then the builder maintains the building.

Where do I complain about my owners' association?

To the Regulator the federal government appoints under the bill. That body has not been named yet.
