How to Register a Nikah in Pakistan, and Why It Matters Later

Nobody worries about registering a nikah on the wedding day. The problem turns up years later, at a visa office, a bank, or a family court, when somebody asks for proof and there is none.

Signing the nikah nama and registering it are two different things, and the second one does not always happen.

The three documents

The order matters. The union council registration has to exist first. The NADRA certificate is the computerised version of a record that must already be there, exactly as with births.

How registration is supposed to happen

1. The nikah is performed and the nikah nama is completed and signed by both parties, the witnesses and the wali where applicable.
2. The authorised nikah registrar, the nikah khawan licensed for that union council, prepares the Urdu nikah nama on or shortly after the day.
3. The registrar submits it to the union council office for official registration.
4. You collect the registration certificate, and apply for the computerised NADRA certificate if you need it. That is reported to take three to five working days and is issued in English for official use.

Notice who does step three. The registrar files it, not you. That is exactly why it gets missed: the family assumes it is done, and nobody checks. If you are getting married, ask the registrar directly which union council he is filing with and when, then follow up.

What an unregistered nikah blocks

• Updating your CNIC and your NADRA family records.
• Spouse visas and immigration. No embassy will take a photograph of a ceremony as proof.
• Bank and inheritance matters where the relationship has to be proved.
• Registering the birth of a child, where the nikah nama is often asked for.
• Filing for khula or talaq. The union council and the family court require the registered nikah nama to process a divorce.

That last one deserves more weight than it usually gets. An unregistered marriage does not simply inconvenience a visa application. It obstructs a woman trying to leave that marriage, at the moment she is least equipped to deal with an administrative problem. Registration is a protection, and it protects the weaker party most.

Registering a marriage years late

It can be done. Late marriage registration exists and is used regularly, usually when somebody discovers the gap while applying for a visa.

Expect to provide more than a recent registration would need: the original nikah nama, CNICs of both spouses, witness details and often affidavits. Where the original nikah nama has been lost, the process is harder and is where legal help genuinely earns its fee.

Start it before you need it. Doing this under the deadline of an embassy appointment is how people end up paying agents for something they could have arranged calmly.

Practical points worth knowing

1. Check the spelling of both names against the CNICs before signing. A mismatch here follows you into every document afterwards.
2. Keep the original nikah nama. Not a photocopy and not a phone photograph. Store it where you store the CNICs.
3. Read the clauses. The nikah nama contains terms, including on delegated right of divorce and mehr, that have real legal effect and are routinely left blank or filled in without discussion.
4. Get the English certified copy if there is any chance of using it abroad.
5. Confirm which union council holds the record, and write it down. You will need it later.
