Almost everyone in Pakistan believes a rent agreement becomes binding when it is written on stamp paper. It does not.

Stamp paper is a tax instrument. It shows duty has been paid. The step that actually gives an agreement legal weight is registration, and most tenancies in Pakistan never reach it.

That gap is why so many deposit disputes end with one person simply keeping the money.

Landlords often prefer to stop at level three, and tenants usually do not know there is a level four. Registration also creates a record of the rent, which is exactly why some landlords avoid it.

The rules are provincial

Tenancy is a provincial subject. The governing law, whether registration is required, the stamp duty value and which authority handles it all differ between Punjab, Sindh, Khyber Pakhtunkhwa and Balochistan.

We are deliberately not printing a single stamp paper value or registration fee, because there is no national figure and one province's number would be wrong for most readers. Confirm the current requirement for your own city before you buy anything.

Getting it done properly

Steps to make a rent agreement properly in Pakistan
  1. Agree the terms first, in writing, before any money changes hands. A deposit paid on a handshake is the hardest money in Pakistan to get back.
  2. Have the agreement drawn on stamp paper of the value your province requires.
  3. Both parties sign, with witnesses, and attach CNIC copies of everyone.
  4. Register it with the relevant authority. This is the step that matters and the one most people skip.
  5. Keep an original. Not a photocopy, and not a photograph on a phone you might lose.

The six clauses arguments are actually about

Nobody argues about the rent. It was negotiated hardest and both sides remember it. Disputes are about these.

The clauses that rent disputes in Pakistan actually turn on
  1. The security deposit. How much, and precisely what can be deducted. "Damages" without a definition means whatever the landlord decides at the end.
  2. Repairs. Who pays for what, and the value threshold between a tenant's small repair and the owner's structural one.
  3. Notice. How much each side must give, and in what form. Verbal notice is worth what verbal agreements are worth.
  4. The annual increase. Write it as a fixed percentage. "To be agreed later" means an argument every year with the stronger party winning.
  5. Utilities. Which bills are the tenant's, and a written confirmation that existing arrears are cleared before handover. Unpaid utility dues usually attach to the property.
  6. Subletting. Allowed or not, stated plainly.

Two more worth adding if you can: what happens if the property is sold during the tenancy, and who holds responsibility for a fixture that fails, such as a geyser or an air conditioner.

Before you sign, check the property

A written agreement does not help if the person signing it does not own the property, and that is not a rare problem.

Also ask for a utility clearance. Arrears on electricity, gas or water tend to follow the property rather than the person who ran them up, and a new tenant can inherit a disconnection notice.
