A wooden gavel on a dark wooden table, for a report on petitions in the Peshawar High Court against the Khyber Pakhtunkhwa emergency

Short answer: At least two petitions in the Peshawar High Court challenge the emergency and governor's rule in Khyber Pakhtunkhwa (KP). One was reported on 12 October 2026 and one, from PTI chairman Barrister Gohar Ali Khan, on 14 October. We found no confirmed hearing date or bench.

The federal government announced the emergency and governor's rule on 11 October 2026. Our first report is in Emergency and governor's rule imposed in Khyber Pakhtunkhwa. This page covers the court challenge only. It states what the petitions ask for and does not take a side.

At least two petitions now challenge the KP emergency and governor's rule

Two petitions are reported. A lawyer, Salman Khan, filed a writ petition by 12 October. PTI chairman Barrister Gohar Ali Khan filed a second one, through lawyer Ali Zaman, and the reports on it are dated 14 October. Both are in the Peshawar High Court.

We have not seen the petitions themselves. We have not seen a court order either. What follows comes from reports of the filings, and we mark it as reported. The reports of the second petition do not name the respondents, so we do not list them for it.

The two petitions ask the court to set aside the emergency and governor's rule

The reported requests are close. Both ask the court to declare the emergency and governor's rule unlawful. The first also asks the court to suspend the governor's rule Proclamation until a final decision. The second asks for the elected provincial government to be restored.

The federal side has given its own reasons for the measures. Reports say it cited the security situation in the province. We have not seen those reasons in an official document, as our first report explains.

What the two reported petitions against the KP emergency and governor's rule ask the Peshawar High Court

No hearing date or bench is confirmed

The reports of both filings give no hearing date and name no bench. The second only says the party asked for an early hearing. We also looked for a date of 20 October and found no cause list or report that confirms it, so do not plan around it.

Court dates change often. A matter can be listed one day and moved the next. The most reliable source is the Peshawar High Court's own daily cause list. We did not find a listing for these petitions on 17 October 2026.

The Constitution sets time limits that keep running while the case waits

The constitutional text puts time limits on both measures. An emergency under Article 232 and a governor's rule Proclamation under Article 234 each end after two months unless a joint sitting of Parliament approves them. Governor's rule cannot run longer than six months in all.

Rule in the textArticle 232 emergencyArticle 234 governor's rule
Ends unless approved by a joint sittingAfter two monthsAfter two months
Longest it can runNo fixed maximum in the textSix months

These points come from the Constitution as published on the Pakistan Code, which we read on 1 October 2026. They are set out in our explainer on Article 232 and Article 234. The Proclamation was announced on 11 October, so the first two month mark falls in December 2026.

Time limits in the Constitution for an Article 232 emergency and Article 234 governor's rule

Article 236 is part of the legal background to the case

The text of Article 236 says the validity of a Proclamation "shall not be called in question in any court". How that wording applies to these petitions is a question for the court. We do not predict the outcome, and the reports do not say how the petitions answer it.

The petitions reportedly rely on other points as well, such as the tests in Articles 232 and 234 and the effect on rights. We cannot judge those without the petitions and the Proclamation text. We have not found the text on an official government site.

What is and is not confirmed about the Peshawar High Court petitions on the KP emergency and governor's rule

What residents of Khyber Pakhtunkhwa can do while the case waits

Nothing in the filings changes daily life by itself. Services, schools and offices follow the notices of their own authorities. If you have an exam, a court date or a trip, ask the school, board, court or office directly before you travel. For one example, see our note on the BISE Peshawar SSC Annual-II suspension.

  1. Check the notice of the body you need, such as the school, board or office, for any change.
  2. If you have a case of your own in a KP court, ask your lawyer or the court office before you go.
  3. To follow these petitions, look at the Peshawar High Court's daily cause list on its own website.
  4. Read the Proclamation text if and when it appears on an official government page, and compare it with reports.

Common questions about the Peshawar High Court petitions

Who has challenged the KP emergency and governor's rule in court?

Two petitions are reported. Lawyer Salman Khan filed one by 12 October. PTI chairman Barrister Gohar Ali Khan filed another, reported on 14 October.

When will the Peshawar High Court hear the petitions?

We found no confirmed date. A date of 20 October has been mentioned, but we found no cause list or report that confirms it. Check the court's cause list.

What do the petitions ask for?

They ask the court to declare the emergency and governor's rule unlawful. One also asks to suspend the Proclamation until a final decision, and the other asks for the elected government to be restored.

Does the court case stop the emergency?

Not by the filing alone. The reports do not show any court order suspending the measures. A suspension would need an order, and we have seen none.

How long can governor's rule last?

The Constitution's text says an Article 234 Proclamation ends after two months unless a joint sitting approves it, and it cannot run more than six months in total.

Where is the Proclamation text?

We did not find it on the President's, the Prime Minister's or the Press Information Department's pages when we looked on 12 October 2026. Our first report says so.

How we verified this

What we checked, where we read it, and what we could not confirm.

Last checked 17 October 2026. The filings, their requests and the lack of a hearing date are reported from news coverage dated 12 and 14 October 2026, and we have not seen the petitions or any court order. Time limits come from the Constitution on the Ministry of Law and Justice's Pakistan Code site, which we read on 1 October 2026. Please confirm hearing dates on the Peshawar High Court's own cause list.
