How to Register a Nikah and Talaq in Azad Kashmir: One Week and Thirty Day Rules
Azad Kashmir's 2020 Act sets one week to record a nikah and thirty days to register a talaq. See who acts, the registrar's role and the penalty for default.

Short answer: In Azad Kashmir, the person who performs a nikah must enter it in the nikah register and deliver a copy to the area sub-registrar within one week. A talaq must be registered within thirty days with the Tehsil Mufti or deputy registrar. Failing to do either can bring up to one month in jail or a fine of up to Rs 1,000.
A family in Muzaffarabad holds a nikah at home. The nikah khwan writes the entry, the couple keep the paper, and nobody thinks about the government register. Years later, a bank, an embassy or a court asks for the registered copy.
We read the Azad Jammu and Kashmir Nikah and Talaq Registration Act, 2020 (Act XXXVI of 2020) on the Law Department's website on 13 October 2026. It is a scanned Urdu gazette, so we read the pages as images. We did not visit a registrar's office. This page is the Act's own rules in plain English, and the Act applies in Azad Jammu and Kashmir only.
The Act sets up registrars in every district
The Azad government appoints a director for nikah and talaq registration, and sets up an office of registration in each district. District and Tehsil Muftis can be appointed registrars and deputy registrars. The Act overrides local custom and repeals the 1986 Nikah Registration Act.
The Act defines a nikah register, a talaq register and an index. Each registrar keeps the nikah register for his area and enters the nikahs in it. A talaq certificate is the document issued under the Act once a talaq is registered.
Registrars and deputy registrars use a seal with the words of the Act's official form. Deputy registrars work under the registrar, and the director supervises the whole system.
The nikah khwan has one week to record and send the nikah
Whoever performs a nikah must record it in the nikah register and send one copy to the area sub-registrar within one week, by registered post or by hand against a receipt. The sub-registrar then enters it in the register.
The duty falls on the person who performs the nikah, not on the couple. Still, the couple should ask for a copy and note the date. If the nikah khwan fails to do this, the Act sets a penalty of up to one month in prison, a fine of up to Rs 1,000, or both.
- Ask the nikah khwan to enter the nikah in the register at the ceremony.
- Note the date, the register number and the khwan's name.
- Check after one week that the copy reached the area sub-registrar.
- Ask the sub-registrar's office for a certified copy of the entry.
- If the entry is missing, appeal to the registrar.

Any complaint about the nikah khwan or a sub-registrar goes to the registrar. The director supervises the system, and the registrar's decision is final under the Act. A talaq must be registered within thirty days
A husband, or a wife who holds a delegated right of talaq, must get the talaq registered within thirty days with the Tehsil Mufti or deputy registrar. A talaq nama made abroad can be attested by an embassy and posted.
If the talaq is given with both spouses present, each should receive written notice from the other. If not, the person giving the talaq must send a written notice to the other side within one week. The deputy registrar enters the talaq in the talaq register. The Tehsil Mufti decides the nature of the talaq and the matters that go with it.
| Event | Who acts | Time limit | Penalty for default |
|---|---|---|---|
| Nikah entry and copy to sub-registrar | Nikah khwan | One week | Up to 1 month or Rs 1,000, or both |
| Talaq registration | Husband, or wife with delegated right | Thirty days | Up to 1 month or Rs 1,000, or both |
| Written notice of talaq to the other side | Person giving the talaq | One week | Up to 1 month or Rs 1,000, or both |
| Appeal on irregularity | Aggrieved person | To the registrar | Not applicable |

The Act deals only with registration. It does not set rules on maintenance or custody. The registered record is the proof that the talaq was pronounced and notified.
What the Act does not tell us
The Act sets no fee, form number or office address. Rules may do that later. We could not find rules or a notified fee on an official page, so ask the registrar's office for the charge in writing.
A registered record matters when you change marital status on the CNIC, as described in how to update your CNIC after marriage. If a second marriage is planned, the steps to get second marriage permission from an arbitration council may also apply. Check which law governs your case in Azad Kashmir before you act.

How we verified this
What we checked, where we read it, and what we could not confirm.
Last checked on 13 October 2026, Pakistan time. We read the Azad Jammu and Kashmir Nikah and Talaq Registration Act, 2020 on the AJK Law Department website. The PDF is a scan in Urdu, and we read the periods of one week and thirty days from the page images, so confirm them with the registrar. We could not verify any fee, rules or office address.
