Short answer: In Islamabad, a landlord must let a property by a written tenancy agreement and present it to the Rent Controller within 30 days of signing. Rent rises automatically by 10 per cent at the end of every year of tenancy, unless both sides agree otherwise in writing. Rent disputes go first to a Mediation Council that has 30 days.

Most Islamabad tenants have a stamp paper in a drawer and nothing else. The rent went up Rs 5,000 last year because the landlord asked, and nobody wrote it down. The law for the capital is stricter than that habit, and it protects both sides.

We read the Islamabad Rent Restriction (Amendment) Act, 2021 in the Gazette of Pakistan of 9 December 2021, on 12 October 2026. It changes the Islamabad Rent Restriction Ordinance, 2001, and we have not read the full consolidated Ordinance. This applies to the Islamabad Capital Territory only. We are not lawyers, so take your own agreement to one before a dispute.

The landlord must present the agreement to the Controller within 30 days

Section 5 says a landlord may not let out premises except by a written tenancy agreement. The landlord must present it to the Controller within 30 days of signing. The Controller records the tenancy in a register, seals the agreement, keeps a copy and returns the original.

The Controller's entry does not replace registration under the general law on registration of documents. A tenancy agreement entered in the Controller's office, or a certified copy, is proof that the landlord and tenant relationship exists. That is useful if the landlord later denies you are a tenant.

Any other agreement between the same two people about the premises must be presented the same way. A side letter about rent counts.

Rent rises 10 per cent a year unless you write otherwise

Section 10 says rent on residential and non-residential buildings goes up automatically at the end of every one year of tenancy, by ten per cent of the rent already being paid. This does not apply if the landlord and tenant agree in writing to increase it differently or not at all.

The wording is "ten per cent of the rent already being paid", so each year's rise builds on the last.

Year of tenancyMonthly rent if nothing else is agreedRise that year
Year 1Rs 50,000None
Year 2Rs 55,000Rs 5,000
Year 3Rs 60,500Rs 5,500
Year 4Rs 66,550Rs 6,050

The sums above are our worked example, not a figure from the Act. Your own agreement may set a different rise, and that is lawful if it is in writing.

Rent must be paid by crossed cheque or against a receipt

Section 8 lets the landlord and tenant fix the opening rent by mutual agreement. It also says every payment connected with the tenancy must go by crossed cheque or against a proper receipt or acknowledgement. This is the rule that protects you in a rent dispute.

A crossed cheque is a cheque marked so it can only be paid into a bank account. A bank transfer to the landlord's account serves the same purpose in practice, but the Act's own words are crossed cheque or receipt, so ask for a receipt anyway. Our guide on rent agreements and stamp paper covers the paper side.

A Mediation Council hears disputes before the Controller decides

Section 16A creates a Mediation Council. The Islamabad Chamber of Commerce president, or a nominee, is the convener. One representative of the tenant and one of the landlord sit with him. Every dispute under the Act, including goodwill, is sent to this council.

  1. At the first hearing after the other side is served, the Controller refers the matter to the convener.
  2. Both sides appear before the convener within 7 days.
  3. Each side nominates a representative within 3 days, authorised in writing and attested by an Oath Commissioner.
  4. The council meets within 7 days of the nominations and sits day to day.
  5. It must finish within 30 days.
  6. A settlement deed is signed and filed with the Controller within 7 days, and the Controller's order on it is final.

If there is no settlement, or one side withdraws, the council tells the Controller in writing and the Controller continues the case. Copies of the settlement deed are free. An appeal may lie from an interlocutory order of the Controller. That is an order made during the case, not the final one.

What to do as a tenant or landlord this week

Check that your agreement is in writing, ask whether it was presented to the Controller, and keep every rent receipt. If you are a landlord, present it within 30 days. If you are a tenant, ask for the Controller's seal on your copy.

Police registration is a separate duty. See how to register a tenant with Islamabad Police. If you are a landlord, rent also has tax effects, explained in tax to deduct from rent in 2026-27.

For the wider rules in other cities, read Pakistan's rent laws. Utility bills are a common fight, and who pays a tenant's unpaid electricity bill explains the rule.

Common questions

Who must take the tenancy agreement to the Rent Controller?

The landlord. Section 5 puts the duty on the landlord, and it must be done within 30 days of signing the agreement.

Can my landlord raise the rent by more than 10 per cent?

Only by a written agreement. Without one, the Act sets an automatic rise of 10 per cent at the end of each year of tenancy.

Is a verbal tenancy legal in Islamabad?

The Act says a landlord may not let out premises except by a written agreement. A verbal arrangement leaves you without the proof the Act values.

How long does the Mediation Council have?

It must meet within 7 days of nominations and complete its work within 30 days. A settlement is filed with the Controller within 7 days.

Does the Controller's entry replace registration?

No. The Act says the Controller's entry does not remove the duty to register the agreement under the law on registration of documents.

What penalty applies if the landlord does not present the agreement?

We did not read a penalty in the amending Act. The full Ordinance may carry one, so ask a lawyer or the Controller's office.

How we verified this

What we checked, where we read it, and what we could not confirm.

We read the Islamabad Rent Restriction (Amendment) Act, 2021 on the National Assembly website on 12 October 2026. It substitutes sections 5, 8 and 10, adds section 16A and amends section 21. We did not read the consolidated 2001 Ordinance or any later amendment, the eviction grounds, or the penalties. Check for a newer amendment before you act.
