How to Stand Surety for Someone's Bail in Pakistan: Bond, Duties and Risks
Standing surety for bail in Pakistan means signing a bond that the accused will attend court. Read what section 499 requires, how to leave and what you risk.

Short answer: A surety is a person who signs a bond with the accused, promising that the accused will attend court on the dates fixed. Section 499 of the Code of Criminal Procedure requires one or more sufficient sureties when bail is granted. If the accused skips court, the bond can be forfeited.
Someone you love is arrested, the court allows bail, and the judge asks who will stand surety. You say yes in a second. You should know what you have signed.
We read the Code of Criminal Procedure on the Pakistan Code website on 14 October 2026. The text we read was last amended on 16 February 2017. We did not read what documents each court office asks for in practice.
A surety promises the accused will attend court
Section 499(1) says the accused must sign a bond for a sum the court thinks sufficient before release. When he is released on bail, one or more sufficient sureties must also sign, promising he will attend at the time and place named.

The promise continues until the court or police officer says otherwise. If the case needs it, the bond can also bind the accused to appear in the High Court or Court of Session when called.
Section 498 adds a protection. The amount of every bond must be fixed with due regard to the circumstances of the case, and it must not be excessive. If the sum seems too high, ask the court to reduce it.
For the stage before this one, read how to get bail in Pakistan. It explains which offences carry bail as a right and which need a court order.
The steps from bail order to release
The court allows bail and fixes the bond amount. The accused and the surety sign the bond. The court then sends a release order to the jail officer, who must release the accused. Section 500 says the person is released once the bond is executed.

- The court grants bail and decides the sum of the bond.
- The accused finds a surety who is willing and able to sign.
- The surety and the accused execute the bond before the court.
- If the accused is in jail, the court issues an order of release to the jail officer.
- The accused attends every date. The surety should keep a note of them.
The release can still be refused if the person is held for some other matter. Section 500(2) says the section does not require the release of anyone who can be detained for a different case.
We could not confirm from the statute what papers the court office wants from you as surety, such as proof of property or income. That varies by court, so ask the reader or the court staff before the day of the hearing.
A surety can leave the bond by going to a Magistrate
Under section 502, any surety can apply to a Magistrate at any time to be discharged from the bond. The Magistrate then issues a warrant to bring the accused in, and the accused must find another surety or go to custody.
This means a surety is not stuck for the whole length of the case. If you fear the accused will run, or you lose touch, go to the court early. Do not wait for a missed hearing.
| Situation | Section | What happens |
|---|---|---|
| Surety wants out | 502 | Magistrate issues a warrant for the accused, who must find a new surety |
| Sureties turn out insufficient | 501 | Court may issue a warrant and order sufficient sureties |
| Accused cannot find a new surety | 502(3) | The accused can be committed to custody |
| Bond amount too high | 498 | High Court or Court of Session can reduce it |
If your relative needs a lawyer for the bail itself, see how to get a free lawyer in Punjab. A lawyer can also tell you how your own court treats a surety.
A forfeited bond can cost you money or property
Section 514 says that if a court is satisfied the bond has been forfeited, it records its grounds and calls on the person bound to pay the penalty or show cause why not. If neither happens, it can attach and sell moveable property.

If the penalty cannot be recovered that way, the person bound can be sent to the civil jail for up to six months. The court may also, at its discretion, remit part of the penalty and enforce only the rest.
Think of it as a promise backed by your goods. Sign only for someone you know well, and only if you can pay the sum in the bond.
The accused, too, should know the limits. If you are the accused, read your rights when you are arrested in Pakistan before your court date.
