Short answer: In urban Khyber Pakhtunkhwa, a tenant or landlord can ask the Rent Controller to fix a fair rent. Under section 4 of the 1959 Urban Rent Restriction Ordinance, the rise cannot be more than 25 percent of the rent being paid on the day you apply. After that, rent cannot rise again for 3 years.

Your landlord sends a message that the rent is going up by half from next month. In an urban area of Khyber Pakhtunkhwa (KP), that jump may not stand. The law gives both sides a way to settle a fair figure through a judge called a Rent Controller.

We read the West Pakistan Urban Rent Restriction Ordinance, 1959, as published on the Khyber Pakhtunkhwa Code (kpcode.kp.gov.pk) on 14 October 2026. The Ordinance applies to urban areas run by a municipal body, and the text excludes the Tribal Areas. It does not apply to Punjab or Sindh, which have their own rent laws. For the Punjab route, see how a Punjab landlord uses the Rent Tribunal.

The Rent Controller fixes fair rent on an application

Section 4(1) says the Controller fixes fair rent on an application by the tenant or the landlord, after an enquiry he thinks fit. The Controller is a judicial officer. The 1959 Gazette named civil judges to this role in the province.

Either side can file. A tenant who thinks the rent is too high can file, and so can a landlord who wants a formal figure. You file for a building or for rented land, and the Ordinance covers homes, shops and offices.

The Ordinance counts a "scheduled building" as a home partly used by a professional such as a lawyer, doctor, architect or dentist. These sit under the same rent rules as other rented buildings.

The Controller must weigh four factors

Section 4(2) lists four factors: rents of similar places in the same locality during the 12 months before you applied, the rise in construction and repair costs, new taxes imposed since the letting, and the rental value in the Property Tax Assessment Register.

Bring proof for each. Collect two or three rent agreements from the same street or block. Bring the latest property tax assessment if you have it. If the landlord paid for repairs or improvements, bring those receipts too. The Controller decides after hearing both sides.

  1. Prepare a short written application naming the building, the rent paid and the rent claimed.
  2. Attach your tenancy agreement, rent receipts and any property tax papers.
  3. File it with the Rent Controller who has jurisdiction over the area.
  4. Attend the hearing and bring local rent comparisons from the past 12 months.
  5. Pay the fair rent from the date the Controller fixes, which is never earlier than your filing date.

The rise cannot pass 25 percent of the present rent

The proviso to section 4(2) says the increase in rent the Controller fixes shall not exceed twenty-five percent of the rent being paid on the date the application is filed. The new fair rent starts from a date set by the Controller, not before filing.

An example makes it clear. If a tenant pays Rs 20,000 a month today, the fair rent the Controller sets cannot be more than Rs 25,000. The cap applies to the rise the Controller can grant in one fixing. It does not stop the Controller from setting the rent lower.

If the Controller finds the current rent already fair, he can leave it as it is. The cap is a ceiling, not a target.

No second rise for 3 years

Section 5 says that once fair rent is fixed, or rent is agreed between the two sides, no further increase is allowed during the tenancy for 3 years. The only exception is an addition or improvement made at the landlord's cost, at the tenant's request.

The three years run from the date the Controller fixes, or from the date of the agreement. If the landlord does improve the place on the tenant's request, the new rent cannot be more than the fair rent for a similar improved building nearby. It is not chargeable until the work is done.

A landlord cannot charge a premium or extra rent

Sections 6 and 7 stop a landlord from taking any premium, fine or like sum on top of rent. After fair rent is fixed, he may take an advance of up to one month's rent. Any agreement for more is void, and extra paid must be refunded or adjusted.

This covers the "pagri" or key money some landlords ask for. Section 7 says no landlord shall ask for any fine, premium or other like sum for granting, renewing or continuing a tenancy. Section 8 lets a tenant deduct such an unlawful payment from rent, but only after the Controller approves, with an application filed within six months.

The advance rule is narrow. A big security deposit is not what the Ordinance allows after fair rent is fixed. If your landlord holds more than one month, raise it before the Controller.

Taxes, repairs and amenities have their own rules

Section 9 lets a landlord, with the Controller's approval, raise rent when a new rate, cess or tax is levied on the building, but the rise cannot pass half of the tax. Landlords cannot pass on other taxes. A tenant can also complain if amenities are cut off.

Under section 10, the landlord may not disturb any convenience, remove anything provided for permanent use, or stop a service that is part of the fair rent. A tenant can complain to the Controller, who can order the amenity restored. Under section 12, if the landlord does not make needed repairs, the Controller can let the tenant do them and deduct the cost from rent.

Section 11 stops anyone from changing a residential building to a non-residential one without the Controller's written permission. For national rules on notices and rises, read what to do when your landlord raises the rent.

A new owner must tell the tenant by registered post

Section 13-B says a new owner, whether by sale, gift, inheritance or otherwise, must send written notice of the transfer to the tenant by registered post. The tenant is not in default if he pays rent within 30 days of when the notice should normally have reached him.

If you are a tenant and the building changes hands, ask for the new owner's details in writing before you pay anyone. Keep money order receipts or Controller deposit slips as proof. Section 13 treats rent sent by money order or deposited with the Controller as duly tendered.

Appeal within 30 days

Section 15 allows a party to appeal against the Controller's order under section 4, 10, 12 or 13 to the District Judge within 30 days. Orders of an interim kind and orders on deposit of rent under section 13(6) have no appeal.

The District Judge can stay the order, or send the appeal to an Additional District Judge. The Controller's order, subject to appeal, is final and cannot be questioned in any court, including the High Court, by suit or appeal, according to section 15(7). Keep the 30 day limit in mind from the day the order is made.

A landlord who breaks section 10(1), 11 or 18 can be fined up to Rs 1,000 under section 19, but only on a complaint filed with the Controller's sanction.

Most the Controller can raise rent in one fixing

Common questions

Can a landlord in Peshawar raise rent by 50 percent?

Not through the Controller. If either side applies, the rise the Controller can fix cannot pass 25 percent of the rent being paid on the filing date. Agreeing a higher rent privately is not the same as a fixed fair rent.

How often can rent go up in Khyber Pakhtunkhwa?

Once every 3 years during a tenancy, after fair rent is fixed or agreed. The only exception is an improvement the landlord makes at the tenant's request and cost.

Can my landlord ask for a large advance or pagri?

No. Section 6 allows an advance of up to one month's rent after fair rent is fixed. Section 7 bars any fine or premium for granting or renewing a tenancy. A tenant can challenge more before the Controller.

Where do I file for fair rent?

With the Rent Controller who has jurisdiction over the building's area. We did not find a fee or a fixed form in the Ordinance. Ask the civil court in your district for the current process.

Does this law apply in a rural area?

No. The Ordinance covers urban areas administered by a Municipal Corporation, Municipal Committee or Town Committee. Rural land tenancy follows other laws, such as the KP Tenancy Act, 1950.

Is there a time limit to appeal a Controller's order?

Yes. You have 30 days from the date of the order to appeal to the District Judge. Some interim orders cannot be appealed.

How we verified this

What we checked, where we read it, and what we could not confirm.

Last checked 14 October 2026. We read the full text of the West Pakistan Urban Rent Restriction Ordinance, 1959 as adapted for Khyber Pakhtunkhwa, on kpcode.kp.gov.pk, including sections 4 to 15, 18 and 19. We did not find a court fee or an application form, and we did not check the notifications that name current Controllers. Confirm both at your district court.
