Short answer: A man who pronounces talaq must send written notice to the Union Council Chairman and give his wife a copy. Under section 7 of the Muslim Family Laws Ordinance, the talaq is not effective until 90 days after the Chairman receives that notice, unless it is revoked before then.

A talaq said in anger on Monday does not end a marriage on Tuesday under this law. The Ordinance puts a waiting period and a reconciliation step in between. That rule matters to both sides. The husband must act, and the wife can check that he did.

We read the Ordinance on the Pakistan Code website on 14 October 2026. The text we read is marked as updated till 10 March 2022. We did not read the provincial rules that set the form and fee of the notice.

The husband must send written notice to the Chairman

Section 7(1) says any man who wishes to divorce his wife must, as soon as may be after pronouncing talaq in any form, give the Chairman written notice. He must also give his wife a copy of that notice.

Four steps from talaq to an effective divorce under section 7 in Pakistan

The Chairman is the Chairman of the Union Council, or a person appointed by the government to do that job. In cantonment areas the federal government appoints, and in other areas the provincial government does. The law applies to all Muslim citizens of Pakistan, wherever they live, including abroad.

  1. The husband writes a notice that says he has pronounced talaq.
  2. He delivers the notice to the Union Council Chairman.
  3. He gives his wife a copy of the same notice.
  4. The wife keeps her copy and notes the date it reached her.

The wife should keep proof of the date. The 90 days are counted from the day the Chairman receives the notice, not from the day talaq was said.

The talaq is not effective until 90 days have passed

Section 7(3) says a talaq, unless it is revoked earlier, expressly or otherwise, does not take effect until 90 days after the day the notice is delivered to the Chairman. Until then the marriage continues in law.

The number 90, the days before a talaq takes effect under section 7 of the Muslim Family Laws Ordinance

Revoked means taken back. A husband can withdraw the talaq inside the 90 days. If he does, the marriage goes on. The Ordinance does not give a form for revocation in the text we read.

This waiting period explains why a divorce certificate cannot be issued the same week. If you need the paper after the period ends, read how to get a NADRA divorce certificate after talaq or khula. For Islamabad, the steps are in how to register a divorce with the Arbitration Council.

The Chairman must form an Arbitration Council within 30 days

Section 7(4) says the Chairman must set up an Arbitration Council within 30 days of getting the notice. Its job is to try to bring the husband and wife back together, and it must take all steps needed for that.

The Arbitration Council has the Chairman and one representative of each side. If one side does not name a representative in time, the Council can sit without that person. Court procedure rules and the Arbitration Act of 1940 do not apply to it.

Pregnancy and remarriage change the timing

If the wife is pregnant when talaq is pronounced, section 7(5) says it is not effective until the 90 days pass or the pregnancy ends, whichever is later. A couple can remarry each other without an intervening marriage, unless it is the third effective talaq.

Key time limits in section 7 of the Muslim Family Laws Ordinance for talaq in Pakistan

Section 7(6) lets a wife whose marriage ended by an effective talaq marry the same husband again, without a marriage to a third person in between. That changes only after the third time the termination takes effect.

Section 8 says the same steps, with the changes needed, apply when a wife uses a right to divorce that was delegated to her, or when either side ends the marriage in a way other than talaq. For a wife who wants to end the marriage in court, see khula in Pakistan.

The Ordinance also has a separate rule for people who follow Fiqah-e-Jafria. It asks for a talaq in Arabic words before two witnesses, and says a talaq made in jest, anger or under pressure is ineffective. Those words were added by a 2021 Act. If this applies to you, ask a family lawyer how the courts read it.

Skipping the notice is an offence

Section 7(2) says a man who does not give the notice can be punished with simple imprisonment of up to one year, a fine of up to Rs 5,000, or both. The Ordinance does not say who files the complaint.

We could not confirm how the courts treat a talaq pronounced without any notice, because that is a question of case law, and we read only the statute. Do not assume either way. A family lawyer can tell you what your district court has held.

A wife who has no copy of any notice can ask the Union Council whether one was received. Keep any message, voice note or written paper in which talaq was pronounced, and the date. If you cannot pay for a lawyer, free legal aid in Punjab is one place to start.

Common questions

Does talaq end the marriage the moment it is said?

No, under section 7(3) it is not effective until 90 days after the Chairman receives the notice. The talaq can be revoked inside that time.

Who is the Chairman?

He is the Chairman of the Union Council, or a person the government appoints to do the job. Cantonment areas and other areas have different appointing governments.

What if the wife is pregnant?

Talaq is not effective until the 90 days pass or the pregnancy ends, whichever is later. That is the rule in section 7(5).

What is the penalty for not sending the notice?

Simple imprisonment of up to one year, a fine of up to Rs 5,000, or both, under section 7(2).

Can a couple remarry after talaq?

Yes. Section 7(6) lets them marry again without an intervening marriage, unless the termination took effect for the third time.

How we verified this

What we checked, where we read it, and what we could not confirm.

Last checked on 14 October 2026, Pakistan time. We read the Muslim Family Laws Ordinance, 1961 on the Pakistan Code. We did not read the provincial rules for the notice form or fee, or any court judgment, so check those with your Union Council or a lawyer. This page explains the law and is not legal advice.
